The High Court of Cassation and Justice, sitting as the Full Court for resolving legal issues, dismissed as inadmissible four connected preliminary reference requests submitted by the Bucharest Court of Appeal. The dispute involved a legal question on whether the principles of non-discrimination and equality under Article 6(b) and (c) of the Framework Law no. 153/2017 on the salary of public-funded personnel permit the equalization of salary rights to the maximum level, comparing them to those of similar personnel employed by different budget-holders or institutions within the same occupational family. The decisive legal basis for the dismissal was the inadmissibility of the proceedings under Article 521(3) of the Civil Procedure Code, which mandates that the court's decision on the admissibility of such preliminary references is binding.
