Limits of criminal revision scope: inadmissibility of re-qualification and new evidence claims under Art. 397 et seq. C. proc. pen.
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the criminal appeal as unfounded, upholding the lower courts’ rejection of the defendant’s revision request and ordering the appellant to pay 800,000 lei in state judicial expenses. The dispute concerned a criminal revision proceeding initiated by a convicted individual who sought to alter the legal qualification of his conviction and admit new evidence, arguing that additional proof would change the charge. The court held that the claimed grounds were inadmissible in a revision action, which is strictly limited to the exhaustive cases provided by law, and therefore could not be re-examined on the merits. The decision was grounded in Articles 397 et seq. and 385, paragraph 1, letter b) of the Romanian Code of Criminal Procedure, confirming that the revision request was properly dismissed as baseless due to the absence of statutory grounds and the appellant’s procedural culpability.

AI generatedThe procedural provision cited as the basis for dismissing the criminal appeal as unfounded in the dispositive.
Although cited in the reasoning to define the limits of revision, it is not explicitly cited in the dispositive orders; however, upon strict review of the dispositive text provided ('PENTRU ACESTE MOTIVE... D E C I D E...'), only Art. 38515 is explicitly cited in the operative part justifying the dismissal. Wait, looking closer at the prompt rules: 'Include a provision only if it is explicitly cited in the dispositive'. The dispositive text provided is: 'Respinge, ca nefondat, recursul... Obliga pe revizuientul...'. It does not contain explicit article citations in the numbered orders themselves. The article 'art. 38515 pct. 1 lit. b) C. proc. pen.' appears in the *reasoning* section ('tot astfel cum urmeaza a fi respins si recursul in conformitate cu dispozițiile art. 38515...'). The dispositive *starts* with 'PENTRU ACESTE MOTIVE IN NUMELE LEGII D E C I D E'. The actual orders are 'Respinge...' and 'Obliga...'. No articles are cited *inside* the orders. The prompt states: 'If the dispositive does not explicitly cite any substantive article, then you must output only the cost and/or legal aid provisions cited there. DO NOT add any other provisions from the reasoning... If the orders impose costs... without citing any article, return []'. The order imposes costs ('Obliga... la cheltuieli judiciare') but does not cite a specific article for the costs in the dispositive block. Therefore, strictly following the rule 'Do not invent articles... If the orders... without citing any article, return []', the result should be empty.

Asupra recursului de față;
