The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Bacău Court of Appeal regarding the interpretation of pension recovery regulations. The dispute centered on whether the statutory provisions mandating the recovery of unduly received social insurance benefits imposed an excessive burden on insured individuals, thereby violating their right to protection of property under Protocol No. 1 to the European Convention on Human Rights, specifically in cases where the beneficiary did not act in bad faith or with intent to deceive the pension house. The Court ruled that the referral was procedurally inadmissible, leaving the lower court to resolve the matter without a binding preclusive interpretation from the supreme court. The decisive legal basis involved the procedural requirements for referral under the Civil Procedure Code and the substantive compatibility of the public pension system's recovery mechanisms with fundamental constitutional and international human rights standards.
