The High Court of Cassation and Justice (Înalta Curte de Casaţie şi Justiţie) rejected as inadmissible the joined referrals from the Dâmboviţa Tribunal (Civil Section I) in cases nos. 6.608/315/2024 and 6.607/315/2024, which sought a preliminary ruling on two issues: whether the limitation period for obtaining forced execution can be invoked via a challenge to execution under art. 715(1)(3) of the Civil Procedure Code as well as under art. 715(1)(1)-(2), interpreted with art. 711 CPC and art. 2,513 Civil Code; and whether an "act of execution" under art. 709(1)(4) CPC means any enforcement act by the bailiff or only the act effectively realizing the debtor's assets. The court declined to rule on the merits, finding the referrals inadmissible; the decision is binding under art. 521(3) CPC, meaning the lower court's questions remain unanswered and the underlying cases proceed.
