The High Court of Cassation and Justice, sitting in its Complete Panel for appeals in the interest of law, admitted the appeal filed by the Presiding Council of the Court of Appeal and issued a binding interpretation establishing that interest under Article 174 of the Fiscal Procedure Code is not due on sums to be restituted following the annulment of administrative acts that imposed budgetary claims arising from regulatory breaches. This decision resolves a dispute concerning the application of emergency orders on the prevention and sanctioning of irregularities in obtaining and using European and national public funds, specifically addressing whether standard tax interest applies when such budgetary claims are subsequently annulled. The Court grounded its ruling in the unitary interpretation of the relevant provisions of Emergency Government Order no. 66/2011 and Article 182 of Law no. 207/2015, determining that the specific legal framework governing the restitution of funds due to annulled administrative acts for fiscal irregularities excludes the obligation to pay the statutory interest defined in Article 174 of the Fiscal Procedure Code.
