The High Court of Cassation and Justice, acting as the full bench for resolving legal issues, dismissed as inadmissible the request by the Cluj Tribunal for a preliminary ruling, thereby leaving the procedural reference unresolved. The dispute concerned a reference on whether the base salary increase mandated by Emergency Government Ordinance No. 19/2024 applies to personnel in social assistance units and centers occupying specific functions listed in the annexes to the Framework Law No. 153/2017 on public sector salaries, a classification that relies on Article 11 of that Law. The court’s decision effectively denies the requested clarification on the applicability of the salary top-up provision (Article I(6) of the Ordinance) to this specific category of public sector employees, with the ruling being mandatory under Article 521(3) of the Code of Civil Procedure.
