Admissibility of preliminary ruling on statutory cap applicability to contributive military pension calculations
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the request for a preliminary ruling filed by the Bacau Court of Appeal as inadmissible, leaving the lower court's procedural posture and the underlying pension calculation dispute unresolved at the supreme level. The case concerned whether a military pension, calculated under the contributivity principle of the 2010 Public Pensions System Law via Article 122 of the 2015 State Military Pensions Law and resulting in a gross amount exceeding that calculated under the standard 2015 rules, is subject to the net pension cap established by Article 60 of the 2015 Law, which limits the net pension to the average net monthly salary or allowance included in the calculation base. The court’s decision was based on the procedural inadmissibility of the reference to the specialized panel for resolving legal issues, as governed by Article 521(3) of the Civil Procedure Code, thereby failing to address the substantive conflict regarding the application of statutory pension caps in mixed-method military retirement cases.
