The High Court of Cassation and Justice upheld the lower court's request for a preliminary ruling, definitively establishing that the panel hearing appeals against decisions by the Commission for the Granting of Financial Compensation to Victims of Crimes must be composed exclusively of judges specialized in criminal matters. This decision resolved a legal uncertainty regarding the specific composition of the appellate court panel under the criminal victim support framework, thereby ensuring that judges with specialized criminal expertise handle these specific civil-administrative cross-overs. The ruling is based on the strict interpretation of Articles 31(6) and 28(2) of Law No. 211/2004, which mandates specialized jurisdiction for matters involving the protection and support of crime victims, and is mandatory for all lower courts pursuant to Article 521(3) of the Code of Civil Procedure.
