The High Court of Cassation and Justice (Înalta Curte de Casaţie şi Justiţie), sitting as a panel for the preliminary resolution of questions of law, dismissed as inadmissible the referral from the Iași Tribunal (First Civil Section) seeking a preliminary ruling on two questions: whether the hospital manager’s opinion under Article 185(7) of Law No. 95/2006 on healthcare reform is advisory or decisive for appointments to head-of-department, head-of-laboratory, and head-of-medical-service positions in public hospitals, and, if decisive, whether it concerns legality or expediency. The court did not rule on the merits, so the underlying case remains pending before the referring tribunal, and the dismissal means no binding interpretation was issued; the decision is mandatory under Article 521(3) of the Civil Procedure Code, applicable only to the inadmissibility ruling itself.
