Prescription period for relocation allowance referral to High Court inadmissible
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the referral from the Bucharest Tribunal seeking a preliminary ruling on two questions of law, thereby leaving the underlying dispute unresolved on the merits. The case concerned the interpretation of provisions on the relocation allowance for public servants under the framework salary law and the ministerial order implementing it, specifically whether the prescription period runs from the date of transfer or change of domicile, and whether suspension of the service relationship for parental leave for a disabled child interrupts or suspends that period. The court held that the referral did not meet the statutory admissibility conditions for a preliminary ruling procedure under the Code of Civil Procedure, as the questions raised did not present the required genuine difficulty or novelty of interpretation warranting a preliminary decision. The dismissal is binding pursuant to the procedural code.
