The High Court of Cassation and Justice rejected as inadmissible the referral by the Prahova County Court for a preliminary ruling on a question of law concerning the calculation basis for monthly indemnities awarded to revolution victims. The dispute centered on whether payments under the 1989 Revolution Recognition Law should be calculated using the average gross salary approved in the state social insurance budget for the relevant year, or by applying specific fiscal-budgetary measures established in Emergency Government Ordinance 90/2017 and subsequently amended by Law 80/2018. The court’s decision to dismiss the referral, rendered under Article 521(3) of the Code of Civil Procedure, leaves the lower court with the original jurisdiction to resolve the case without a unified interpretation from the high court, effectively maintaining the procedural status quo regarding the applicable legal norms for calculating these specific statutory benefits.
