The High Court of Cassation and Justice rejected as inadmissible the preliminary reference submitted by the Bucharest Court of Appeal, thereby denying the lower court the requested clarification on the legal nature of the salary supplement. The dispute concerned a specific administrative-legal question: whether a 50% base salary supplement, established by a 2008 Ministry of Internal Affairs order for specific work conditions and locations, possessed a permanent character or was strictly temporary and contingent on the performance of specific activities in special conditions. By rejecting the reference, the Court determined that the question did not meet the admissibility requirements for a preliminary ruling on a matter of law, leaving the substantive interpretation to the referring jurisdiction without imposing a binding legal precedent from the high court.
