The High Court of Cassation and Justice dismissed as inadmissible the referral from the Court of Appeal concerning the legal question of determining the precise date for partial early retirement under the Labor Code and Law no. 263/2010. The dispute centered on whether the relevant date for this status was the communication of the pension decision, the termination of the labor contract, or the filing of the pension request, specifically in scenarios where the employee continued working between the request and the contractual termination. By rejecting the referral, the court left the issue unresolved at the supreme court level, meaning no binding interpretation was issued to unify practice on the interplay between labor law termination dates and social security entitlement dates for partial early retirement.
