The High Court of Cassation and Justice upheld the unity of the legal crime under Article 157(2) of the Penal Code, ruling that the withdrawal of a preliminary complaint by one victim does not sever the complex offense when the statutory consequence affects multiple individuals, thereby resolving the legal dispute submitted by the Cluj Appeal Court. The case involved a preliminary ruling request regarding whether the complex criminal offense defined in Article 196(4) of the Penal Code, which caused harm to two persons, retains its status as a single legal unit if one victim withdraws their complaint, challenging the applicability of Article 158(2) versus Article 157(2). The decisive legal basis relied on the statutory interpretation that the complex nature of the offense under Article 196(4) maintains its integrity for the entire set of consequences, ensuring that the act is prosecuted as a single unit under Article 157(2) regardless of individual procedural withdrawals.
