Police officers' special-conditions referral inadmissible; classification and leave questions unresolved, appellate case proceeds.
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the referral submitted by the Oradea Court of Appeal seeking a preliminary ruling on four questions of law concerning police officers' entitlement to special working conditions under Government Decision No. 1822/2004, thereby leaving the underlying administrative case (challenging the classification of working conditions and seeking declaratory relief) to proceed under the appellate court's own interpretation. The dispute involved whether a declaratory action is admissible without contesting the individual classification acts, whether effective work in the listed departments is required for special-condition classification, whether "automatic data processing" under Chapter II point 8 of the annex means mere system access or modification of information, and whether special-condition recognition extends to parental leave and professional training periods. The High Court based its decision on procedural inadmissibility grounds, without reaching the merits of the substantive norms, rendering the ruling binding pursuant to Article 521(3) of the Civil Procedure Code.
