The High Court of Cassation and Justice (Înalta Curte de Casaţie şi Justiţie), sitting as a panel for preliminary rulings on questions of law, rejected as inadmissible the joined referrals from the Târgu-Mureș Court of Appeal (Civil Section I) in cases nos. 1041/96/2023 and 823/96/2023, thereby providing no substantive ruling and leaving the underlying appeals unresolved. The referrals sought clarification on whether, under Articles 100 of Law no. 304/2004, Articles 121 and 122(3) of Law no. 304/2022, Articles 2, 4, and 7 of the CSM Regulation no. 325/2005 on judicial leave, Article 8(2) of Ministry of Justice Order no. 2430/C/2006 on judicial assistants' leave, and Articles 55(a), 56(1)(i), 83(h), and 146(3) of the Labor Code, the expiry of a judicial assistant's 5-year mandate constitutes termination of a fixed-term employment contract, and if so, whether unused annual leave can be monetarily compensated when a new 5-year mandate immediately follows. The High Court dismissed the questions as inadmissible, invoking Article 521(3) of the Civil Procedure Code, which renders the decision binding, without addressing the merits of the statutory interpretation.

ÎNALTA CURTE DE CASAŢIE ŞI JUSTIŢIE

Completul pentru dezlegarea unor chestiuni de drept

Minuta deciziei nr. 365 Dosar nr. 727/1/2025

Ședința din 20 octombrie 2025

ÎN NUMELE LEGII

DECIDE:

Respinge, ca inadmisibile, sesizările conexate formulate de Curtea de Apel Târgu-Mureș – Secția I civilă, în dosarul nr. 1041/96/2023 și în dosarul nr. 823/96/2023, având următorul conținut:

„să se stabilească dacă, prin prisma prevederilor art. 100 din Legea nr. 304/2004, art. 121 și art. 122 alin. 3 din Legea nr. 304/2022, art. 2, art. 4 și art. 7 din Regulamentul privind concediile judecătorilor și procurorilor aprobat prin Hotărârea C.S.M. nr. 325/24 august 2005, art. 8 alin. (2) din Regulamentul privind concediul de odihnă și alte concedii ale asistenților judiciari aprobat prin Ordinul ministrului Justiției nr. 2430/C din 27 octombrie 2006, art. 55 lit. a), art. 56 alin. (1) lit. i), art. 83 lit. h) și art. 146 alin. (3) din Codul muncii, având în vedere că asistenţii judiciari sunt numiţi în funcție pentru o perioadă de 5 ani și văzând că acestora li se aplică dispoziţiile prevăzute de lege pentru magistraţi în ceea ce privește concediul de odihnă, se poate considera că încetarea mandatului unui asistent judiciar la sfârșitul perioadei de 5 ani este echivalentă cu încetarea unui contract individual de muncă încheiat pe durată determinată;

521 alin. (3) din Codul de procedură civilă.
