Employer's duty to notify employee of contract reactivation and work resumption date following judicial reinstatement
Legislator summary
AI generatedThe Supreme Court of Romania, acting through its Full Bench for Resolving Legal Issues, admitted the reference posed by the Court of Appeal of Suceava and established a binding legal interpretation, thereby resolving the preliminary question in favor of the procedural requirement for specific notice in reinstatement cases. The dispute concerned the labor law obligations of an employer following a first-instance judgment ordering the reinstatement of an employee after an illegal dismissal, specifically whether the employer must actively notify the employee of the reactivation of the individual employment contract and the effective date for resuming work. Relying on Article 80(2), Article 274, Article 8, Article 17(3)(g), and Article 40(2)(a) of the Labor Code (Law No. 53/2003), the Court ruled that when an employer initiates the execution of a reinstatement judgment, they are obligated to inform the employee regarding the reactivation of the contract and the specific date of resuming labor relations, with this decision being mandatory under Article 521(3) of the Code of Civil Procedure.
