The High Court of Cassation and Justice admitted the referral from the Cluj Court of Appeal and established that maternity risk leave constitutes a statutory suspension of the individual employment contract, resolving the referred question of law. The dispute concerned the classification of maternity risk leave under Romanian labor law, specifically whether it triggers the contractual suspension effects defined in the Code of Labor. The Court decided that in interpreting and applying Article 2(h) of Emergency Government Ordinance No. 96/2003 regarding maternity protection, such leave is legally equated to a suspension of right under Article 50(b) of Law No. 53/2003 (the Code of Labor), as amended. The decision is mandatory for lower courts pursuant to Article 521(3) of the Code of Civil Procedure.
