Taxability of creditor claims for penalty sums in compulsory enforcement of personal obligations under OUG 80/2013 and Civil Procedure Code
Legislator summary
AI generatedThe High Court of Cassation and Justice (ICCJ), sitting as the Panel for Appeals in the Public Interest, admitted the appeal filed by the Prosecutor General, thereby establishing a binding interpretation that such proceedings are subject to a judicial stamp tax of 20 lei. The dispute concerned the correct judicial fee applicable to creditor claims filed during compulsory enforcement, specifically where a personal obligation (an obligation to do or not do something that cannot be performed by another) is unfulfilled and the creditor seeks to establish the penalty sum owed by the debtor. The Court ruled that these claims, brought under Article 906(4) of the Civil Procedure Code, fall under Article 27 of Emergency Government Ordinance No. 80/2013, which mandates a flat 20 lei tax, subject only to specific statutory grounds for objective or subjective exemption. This decision is mandatory and applies to the interpretation and application of Articles 1, 3(1), 10, and 27 of Ordinance No. 80/2013, standardizing the fee structure for such enforcement-related penalty determinations across the Romanian judicial system.
