The High Court of Cassation and Justice dismissed as inadmissible the appeal in the interest of the law filed by the leadership college of the Buzau Court of Appeal, thereby leaving the lower court's position on the procedural issue standing. The dispute concerned whether the presidential decree procedure established by Article 23(3) of Law No. 361/2022 on the protection of public-interest whistleblowers constitutes a derogation from common law, specifically regarding whether it bypasses the mandatory cumulative verification of conditions under Article 997 of the Code of Civil Procedure. Relying on the mandatory nature of procedural rules, the Court applied Article 517(4) of the Code of Civil Procedure to reject the appeal, ruling that the specific statutory mechanism for whistleblower protection does not waive the fundamental admissibility requirements for civil proceedings.
