The High Court of Cassation and Justice rejected as inadmissible the request for a preliminary ruling submitted by the Bucharest Court of Appeal in an administrative-fiscal dispute, leaving the procedural challenge unresolved at the preliminary stage. The referring court sought clarification on whether the Administrative Code, specifically Articles 355, 362, and 363 of Emergency Government Ordinance No. 57/2019, exclusively restricts the disposal of private property owned by the state or local administrative units to specific methods such as administration, concession, lease, or public auction, thereby excluding other legal modalities. The decision was based on procedural inadmissibility criteria under Article 521(3) of the Code of Civil Procedure, which governs the requirements for such constitutional or supreme court interventions, effectively dismissing the substantive question regarding the interpretation of property disposal mechanisms in the Romanian Administrative Code.
