The High Court of Cassation and Justice dismissed as inadmissible the preliminary question referred by the Iași Court of Appeal for resolution. The dispute arose from a labor law conflict concerning whether civil servants employed by prefectures are entitled to the same non-salary benefits, specifically the harmful working conditions bonus, for the duration of their annual leave as they would have received during effective work periods. The referring court sought clarification on the interpretation of the salary framework established by Annex No. VIII, Chapter I, Article 1(1)(B) of Law No. 153/2017 on the payment of public sector employees, as amended. The decision relies on the procedural requirement for the admissibility of preliminary references under Article 521(3) of the Code of Civil Procedure, resulting in the rejection of the submission without a substantive ruling on the underlying salary rights issue.
