Inadmissibility of collective labor agreement clauses on commuting expense reimbursement for non-teaching staff under the Pre-university Education Law
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible a referral submitted by the Bucharest Court of Appeal, thereby upholding the procedural standing of the lower tribunal's position and leaving the substantive interpretation of the referenced collective labor provisions unresolved at this level. The dispute centered on whether specific clauses in the national collective labor agreement for the pre-university education sector create a valid conventional obligation for employers to reimburse commuting expenses for non-teaching staff, specifically administrative personnel defined under the Pre-university Education Law. The decisive legal framework involved the intersection of Article 53(1) read in conjunction with Article 2(3) of the collective agreement, the specific provisions of the Dialogue Social Law No. 367/2022 (particularly Articles 100(1) and 105), and Article 164(4) of the Pre-university Education Law No. 198/2023, with the court's ruling governed by Article 521(3) of the Civil Procedure Code.
