Inadmissibility of reference question on cumulating age-limit pension with salary for de facto continued employment after labor contract expiration
Legislator summary
AI generatedThe Supreme Court of Cassation and Justice dismissed as inadmissible the reference question submitted by the Pitești Court of Appeal, leaving the lower court’s original procedural posture unchanged. The dispute arose from a referral seeking clarification on whether the absence of a termination decision and a lack of a written request to extend an individual labor contract, both occurring before the employee met pension eligibility conditions, could be construed as the parties' intent to establish a new labor relationship that would permit the cumulation of an age-limit pension with a salary under the unified pension system. The decisive legal basis for the inadmissibility ruling involved the procedural requirements for referring questions of law under Article 521(3) of the Code of Civil Procedure, specifically concerning the admissibility of the reference regarding the interpretation of Article 56(1)(c) and (2) of the Labor Code and Article 118(1)(a) of the Unified Public Pensions System Law.

Interpretarea dispoziţiilor art. 56 alin. (1) lit. c) şi alin.
