The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Bucharest Court of Appeal, thereby leaving the lower court's procedural posture unchanged and preventing a definitive supreme court interpretation of the specific labor law questions. The dispute concerned the interpretation of the Labor Code regarding the definition of a "continuous activity period" in terms of minimum duration and whether such a period is interrupted exclusively by a 48-hour weekly rest following a 12-hour shift or by any rest period exceeding the standard 24-hour daily rest. The decision was grounded in the procedural standards for admitting preliminary rulings under Article 521(3) of the Code of Civil Procedure, which rendered the appeal on the substantive issues of Articles 137(1) and (4), read in conjunction with Articles 113 and 115(2) of the Labor Code, admissible for review.
