The High Court of Cassation and Justice dismissed as inadmissible the referral for clarification of law filed by the Hunedoara Tribunal, leaving the underlying civil dispute pending without a definitive legal resolution from this instance. The case involved a challenge regarding the calculation basis for the 20% penitentiary salary supplement, specifically whether it must be derived from the 2009 basic allowance or the current monthly allowance, and whether the provisions of the 2017 Public Sector Wage Framework Law apply to court clerks. The court did not resolve the substantive legal question concerning the interplay between the specific penitentiary allowance rules and the general wage framework legislation, thereby rejecting the procedural mechanism intended to unify case law on this employment matter.
