The High Court of Cassation and Justice (Inalta Curte de Casație și Justiție) admitted the reference submitted by the Timișoara Court of Appeal and established a mandatory legal interpretation, resolving a dispute concerning the procedural applicability of adoption regulations. The core issue was whether the specific provisions governing the adoption procedure, originally enacted in 2004, applied to judicial approvals that had become final prior to the entry into force of subsequent amendments in 2020. The Court ruled that the provisions of Article 100, paragraph 1 of Law No. 273/2004 (as amended) are applicable even when the initial court decision became final before the enactment of Law No. 268/2020, thereby clarifying the temporal scope of procedural rules in adoption cases and establishing a binding precedent for all lower courts under Article 521(3) of the Code of Civil Procedure.
