The High Court of Cassation and Justice dismissed as inadmissible a reference for the preliminary determination of a question of law submitted by a lower tribunal. The dispute concerned whether an adopted child, whose biological parents had been persecuted under the political regime starting in 1945 or deported abroad, was entitled to the higher-tier indemnity established for such victims. The decisive legal framework involved the interpretation of Decree-Law No. 118/1990, specifically regarding the scope of rights for adopted children of political prisoners versus those with full or restricted filiation, alongside procedural admissibility standards under the Civil Procedure Code.
