The High Court of Cassation and Justice, sitting as the Full Panel for the Settlement of Legal Issues, dismissed as inadmissible the referral submitted by the Court of Appeal of Târgu Mureș, thereby upholding the prevailing position that no binding interpretation was required at this judicial level. The dispute concerned the calculation methodology for the monthly allowance under Article 5 of Emergency Government Ordinance No. 111/2010, as amended by Emergency Government Ordinance No. 164/2022, specifically regarding the gap period between the statutory deadline for issuing methodological norms (60 days from December 7, 2022) and the entry into force of Government Decision No. 865/2023 on September 19, 2023. The decision relies on the procedural framework of Article 521(3) of the Code of Civil Procedure, establishing that the court lacks the mandate or basis to issue a preliminary ruling on this specific interpretive gap in social security benefits.
