The High Court of Cassation and Justice dismissed as inadmissible the reference to a preliminary question submitted by the Cluj County Court of Appeal, leaving the lower court's proceedings to continue without a binding ruling from the supreme court. The dispute concerned the legality of legislative measures from Law No. 296/2023 that capped the hazard allowance for public officials with net monthly salaries exceeding 8,000 RON at 1,500 RON and suspended food allowances, with the referring court questioning whether these distinctions violated the constitutional principle of non-discrimination under Article 16. The High Court determined that the submission did not meet the admissibility requirements for a preliminary ruling on a question of law, thereby refusing to address whether the financial measures constituted discriminatory treatment under the Romanian Constitution.
