The Supreme Court of Romania dismissed as inadmissible a referral from the Maramureș County Court seeking clarification on a question of law, thereby rejecting the lower court's attempt to unify legal interpretation. The dispute concerned whether the basic salary level established for 2022 applies to on-call hours performed outside the standard workweek by doctors employed under individual labor contracts for partial-time work to ensure continuity of medical care. The decisive legal basis involved the interpretation of Article 15 of Emergency Governmental Ordinance No. 168/2022, as introduced by Article I of Emergency Governmental Ordinance No. 54/2023, with the admissibility determination governed by Article 521(3) of the Code of Civil Procedure.
