The High Court of Cassation and Justice dismissed the referral for a preliminary ruling as inadmissible, leaving the lower court’s jurisdiction over the specific case intact without establishing a binding legal interpretation for the disputed issue. The procedural dispute involved a challenge to whether certain budgetary funds could be used to reimburse the cost of a medication purchased abroad for a member of the justice system, specifically questioning the scope of gratuitous medical assistance provisions under Government Decision No. 762/2010. The decisive legal basis for the decision rests on the admissibility requirements for preliminary referrals under the Code of Civil Procedure, where the court determined that the question presented did not meet the threshold for a ruling by the Full Panel for the Resolution of Legal Issues.
