The High Court of Cassation and Justice (Înalta Curte de Casaţie şi Justiţie), sitting as a panel for the preliminary resolution of questions of law, dismissed as inadmissible the referral from the Dolj Tribunal (Administrative and Fiscal Litigation Section) in case no. 3368/63/2024, seeking a preliminary ruling on the interpretation of art. II of Law no. 263/2006 approving and amending Government Emergency Ordinance no. 209/2005 on property-law amendments. The question posed was whether public servants from town halls who were also members of the local commission applying Law no. 247/2005 are entitled to the monthly 50% increase of their base salary under art. II of Law no. 263/2006 where they were appointed to that commission after 03.07.2007. The referral was rejected as inadmissible, and therefore no substantive interpretation was given and no ruling was made on the entitlement; the dismissal is binding under art. 521 para. 3 of the Civil Procedure Code.
