The Supreme Court of Romania (High Court of Cassation and Justice) dismissed as inadmissible the request for a preliminary ruling formulated by the Craiova Court of Appeal in a labor dispute concerning the suspension of an employment contract. The case involved a dispute over whether a legal relationship that had not been definitively consolidated before the publication of a Constitutional Court decision declaring certain provisions unconstitutional could give rise to the effects established by a subsequent High Court decision on the interpretation of labor law norms. The court determined that the referral was inadmissible under Article 521(3) of the Code of Civil Procedure, meaning the lower court's decision regarding the suspension remained in force without the requested uniform interpretation on the application of Article 52(2) of the Labor Code in relation to unconsolidated legal relationships.
