Calculation of public sector functional salary and inclusion of pension fund bonuses in statutory pension cap
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the reference for a preliminary ruling submitted by the Bucharest Court of Appeal. The dispute concerned the interpretation of public sector salary laws, specifically whether the "solda de funcție" (functional salary) established under Law No. 153/2017 must be calculated as the product of the hierarchical coefficient and the minimum wage when a comparable function within the same employer or military unit is absent. Additionally, the reference sought clarification on whether the 3%, 6%, and 9% bonuses for contributions to the Supplementary Pension Fund, provided for in Article 108 of Law No. 223/2015, are included within or added to the pension cap of 85% of the functional salary as per Articles 28, 29, and 30 of the same law. The court applied Article 521(3) of the Code of Civil Procedure to determine the inadmissibility of the request, leaving the lower court’s proceedings unaffected by a supreme court interpretation on these specific statutory definitions.
