The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling filed by the Court of Appeal of Cluj in a public administrative and fiscal litigation case, thereby leaving the lower court to resolve the matter without a mandatory legal interpretation from the supreme jurisdiction. The dispute concerned the interpretation of the delegation allowance for public institution personnel under the annex to Government Decision No. 714/2018, specifically whether the allowance is payable only for delegations lasting at least twelve hours and strictly conditional upon the presentation of justificatory documents pursuant to Article 16 of the same annex. The decisive procedural basis for the dismissal was Article 521(3) of the Code of Civil Procedure, which governs the admissibility requirements for preliminary questions of law, resulting in no substantive legal determination on the interpretation of the administrative norms regarding public servant allowances.
