The High Court of Cassation and Justice, in its Complete Court for the Resolution of Legal Questions, dismissed as inadmissible the request for a preliminary ruling filed by the Neamţ Tribunal. The dispute concerned the interpretation of Article 6(b) and (c) of Framework Law No. 153/2017 regarding the salary of public sector employees, specifically challenging whether the non-capping of a base allowance calculated against a sectoral reference value of 605.225 RON applied to judges at lower courts with the same temporal effect as for judges at the High Court (effective January 1, 2018, versus December 30, 2021). The court rejected the referral on procedural grounds, leaving the underlying civil and administrative proceedings pending before the referring tribunal to resolve the specific application of these salary provisions.
