Legislator summary
AI generatedThe High Court of Cassation and Justice, sitting as the Chamber for Resolving Issues of Law, admitted the connected referrals and issued a binding preliminary ruling, determining that the salary rights of judicial police officers seconded from the Ministry of Internal Affairs to the National Anti-Corruption Directorate or the Directorate for Investigating Organized Crime and Terrorism cannot be calculated by reference to Article 11 of Annex No. VI to Framework Law No. 153/2017. The dispute concerned the proper legal basis for determining salary entitlements during the period of secondment, challenging whether the specific article regarding certain career categories in the public salary framework law applied to these specific positions. The decisive legal basis was the interpretation and application of Article 11 of Annex No. VI to Framework Law No. 153/2017, with the court establishing that this provision is inapplicable for salary determination in the context of secondments to the specified anti-corruption and organized crime investigation bodies.
