The High Court of Cassation and Justice dismissed the request for a preliminary decision as inadmissible, meaning the specific legal questions submitted by the Court of Appeal Galați remain unresolved by this ruling. The dispute, arising in a labor and social security context, concerned two distinct issues: first, the calculation method for the hazardous conditions allowance applicable to resident doctors on rotation under specific governmental ordinances, interpreted in light of the public sector salary framework law; and second, whether protective allowance for workplace health and safety can be compensated in monetary terms. The decisive procedural basis for the dismissal was the requirement under Article 521 paragraph (3) of the Code of Civil Procedure regarding the admissibility of such referrals to the full panel for resolving legal issues.
