The High Court of Cassation and Justice dismissed the preliminary reference submission as inadmissible, meaning no ruling was issued on the legal questions raised and the lower court retains responsibility for the case. The dispute concerned whether, for public officials with special status (penitentiary police) on leave for rest, the calculation of leave benefits must include night, isolation, guard, and surveillance premiums as well as risk/health compensation paid during active service periods. The reference, initiated by the Ialomița Court of Appeal, sought interpretation of Article 38(1) of Government Ordinance No. 64/2006 and Articles 150(1) and (2) of the Labor Code, but the Supreme Court found the request procedurally non-compliant under Article 521(3) of the Civil Procedure Code.
