The High Court of Cassation and Justice dismissed the referral submitted by the Tribunal of Alba for a preliminary ruling on questions of law, leaving the lower court's position unchanged without establishing a binding precedent on the substantive issue. The dispute concerned a salary equality claim by military personnel (gendarmes) from a specific county, who challenged whether they were entitled to a minimum hierarchy coefficient of 4.70, consistent with the treatment of similar ranks in other jurisdictions, under the principles of non-discrimination and equality. The decisive legal basis involved the interaction between the salary framework established by Framework Law No. 153/2017 (specifically Art. 6(b)-(c) and Art. 38) and the budgetary limitation measures imposed by Emergency Government Order No. 168/2022 (Art. I(16)), with the Court ultimately finding the referral inadmissible rather than addressing the merit of the salary parity and coefficient interpretation.
