Inadmissibility of referral on public sector salary calculation and prescription starting point
Legislator summary
AI generatedThe Supreme Court of Cassation and Justice, acting as the General Assembly for Resolving Issues of Law, dismissed the referral from the Court of Appeal of Constanța as inadmissible, resulting in the lower court proceeding without a prior binding ruling on the submitted questions. The case involved a dispute over public sector salaries, specifically concerning the calculation of the basic function balance and allowances at the maximum level for similar functions under the 2015 salary ordinance. The court found it unnecessary to resolve the two substantive legal issues referred—which concerned the starting point for the limitation period regarding these salary claims and the mandatory inclusion of the 15% loyalty allowance in the basic function balance—because the referral did not meet admissibility requirements. The decision is based on Article 521(3) of the Civil Procedure Code, which governs the mandatory nature of such referrals, but the operative outcome was purely procedural, leaving the underlying salary calculations to be determined by the referring court.
