The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling on a question of law submitted by the Tribunal of Neamț in civil case no. 416/103/2024, leaving the reference pending without a substantive judicial determination on the merits. The underlying dispute concerned whether the retroactive recovery of unpaid benefits was required for a claimant, a beneficiary of the end-of-age indemnity (retirement compensation for former legislators), following the constitutional invalidation of Law No. 7/2021, which had modified the cessation of such payments; specifically, the referring court inquired if the remedy should align with the damages framework established by Constitutional Court Decision No. 678/2023. The decision relied on the procedural inadmissibility criteria derived from Article 521(3) of the Civil Procedure Code, thereby declining to address the substantive interpretation of the Constitutional Court’s earlier ruling regarding compensation for legislative changes affecting social benefits.
