The High Court of Cassation and Justice dismissed as inadmissible a preliminary reference submitted by a County Civil Court regarding the continuation of a 7.5% salary bonus for public health control activities. The dispute concerned whether, under the framework of Law No. 153/2017 and Emergency Ordinance No. 128/2023, public health officials in county directions performing concrete control activities could retain the specific activity bonus after their base salary was aligned with that of Ministry of Health inspectors, a process limited by Art. V(1) of the Ordinance to cap differences relative to the December base salary within superior structures. The Court ruled that the reference was procedurally inadmissible, leaving the lower court to resolve the individual salary claims without a definitive legal interpretation from the higher instance, thereby upholding the procedural requirement for admissible preliminary references under Art. 521(3) of the Civil Procedure Code.
