The High Court of Cassation and Justice dismissed as inadmissible the reference filed by the Tribunal of Cluj for the preliminary ruling on the interpretation of the police officer housing allowance. The dispute concerned whether a police officer who acquired a residence in a specific locality via a bank loan before being transferred to that same locality in the public interest still met the statutory condition of not owning a personal residence in the place of duty, thereby retaining eligibility for the monthly rent compensation. The Court did not issue a substantive ruling on the legal interpretation but rejected the request for a preliminary decision, leaving the lower court to resolve the issue based on existing law. The decisive legal basis involved the admissibility requirements for preliminary rulings under the Code of Civil Procedure and the specific provisions of the Police Statute regarding housing compensation conditions.
