The High Court of Cassation and Justice dismissed as inadmissible the referral from the Pitești Court of Appeal, leaving the lower court to resolve the case without a preliminary ruling. The dispute concerned whether a public official's service relationship, governed by the Administrative Code, could be automatically suspended while serving as a judicial assistant, specifically questioning the applicability of Labor Code provisions on suspension by reference to the Administrative Code and the Judicial Organization Law. The legal issue centered on the interplay between Article 50(d) and Article 1 of the Labor Code, Articles 367 and 513(1)(m) of the Administrative Code, and specific provisions of the Judicial Organization Law and the Statute of Judges and Prosecutors regarding the status of judicial assistants.
