Mandatory military service as qualifying professional tenure for legal advisor pension rights
Legislator summary
AI generatedThe High Court of Cassation and Justice (Supreme Court) admitted a reference for resolving legal issues, establishing that the period of mandatory military service performed by an individual holding the position of legal advisor counts as tenure in that specific function; consequently, the referral from the Court of Appeal Galati is resolved in favor of the interpretation that such service constitutes relevant professional experience. The dispute concerned the calculation of pension rights and professional seniority for legal advisors, specifically whether time spent in compulsory military service should be recognized as time held in the legal advisor position. The decisive legal basis is the interpretation of Article 49 of Law No. 263/2010 regarding the public pension system, read in conjunction with Articles 1 and 3 of Law No. 46/1996 regarding the preparation of the population for defense, which clarifies that military service during the tenure of legal advisor functions is equated to active service in that role for pension purposes.
