The High Court of Cassation and Justice dismissed as inadmissible the appeal in the interest of the law filed by the Prosecutor General, thereby leaving the lower court's procedural ruling in force. The dispute concerned a request for cassation review of a procedural issue in a non-contentious civil case specifically regarding the registration of a legal act in a public registry, where the core conflict was whether the court was limited to a formal legality check or was empowered to conduct an extensive substantive review of the act's validity. The decisive legal basis for the dismissal was the procedural requirement under Article 517(4) of the Civil Procedure Code, which governs the admissibility criteria for appeals in the interest of the law, confirming that the challenge did not meet the statutory thresholds for such a remedy despite the significant legal question regarding the interpretation of Articles 527, 531, and 535 of the Civil Procedure Code in conjunction with Government Emergency Ordinance No. 26/2000.

ÎNALTA CURTE DE CASAŢIE ŞI JUSTIŢIE

Completul pentru soluționarea recursului în interesul legii

Minuta deciziei nr. 14 Dosar nr. 1072/1/2025

Şedinţa din 30 iunie 2025

ÎN NUMELE LEGII

DECIDE:

517 alin. (4) din Codul de procedură civilă.

Pronunţată în şedinţă publică astăzi, 30 iunie 2025.
