The High Court of Cassation and Justice dismissed as inadmissible a preliminary ruling request filed by the Bucharest Court of Appeal, leaving the lower court to resolve the case without a uniform interpretation. The dispute concerned whether a civil court could order the reinstatement of a specific higher diplomatic grade to remedy a discrimination claim, with the applicant challenging the denial of such a specific professional status under the employment and diplomatic statutes. The court focused on the interpretation of Article 27(1) of Government Ordinance No. 137/2000 regarding the prevention and sanctioning of discrimination, in conjunction with Articles 6, 9, and 11-13 of Law No. 269/2003 on the Status of the Diplomatic and Consular Corps, to determine if judicial measures can mandate the assignment of a specific diplomatic rank established by separate administrative procedures.
