Whether UN Mission Subsistence Allowances for Kosovo personnel equate to domestic diurne and family visit benefits under Government Decision No. 46/2020
Legislator summary
AI generatedThe High Court of Cassation and Justice, acting as the full panel for resolving legal questions, dismissed as inadmissible two consolidated referrals from appellate and tribunal courts, thereby refusing to issue a preliminary ruling and leaving the lower courts to proceed without a binding interpretation. The dispute concerned whether the "Mission Subsistence Allowance" (MSA) paid to military and police personnel for UNMIK Kosovo missions equaled or covered the same costs as domestic currency diurne and family visit benefits established under Romanian Government Decision No. 46/2020, effectively challenging the calculation and rambursification of foreign mission allowances against domestic statutory standards. The Court’s decision rests on the procedural inadmissibility of the referrals under Article 521(3) of the Civil Procedure Code, failing to meet the mandatory requirements for a preliminary question of law regarding the interpretation of the MSA in relation to the Memorandum of Understanding between the Romanian Government and the United Nations, ratified by Emergency Ordinance No. 14/2002 and Law No. 350/2002.
